The NBA legend Testifies He ‘Wasn’t Afraid’ of Nascar in Antitrust Trial

Michael Jeffrey Jordan, introducing himself formally in a federal courtroom on Friday, stated that his competitive side and status as a newcomer emboldened his push for 23XI Racing to confront Nascar over perceived violations of antitrust rules.

Team Investment and a Will to Win

Jordan shared financial and corporate details of his 23XI team, revealing he put in $40 million of his own funds into the Nascar Cup series team co-founded with business partner Curtis Polk and longtime driver Denny Hamlin.

“It fell to someone to act,” Jordan stated during testimony. “I was a new person, I wasn’t afraid. I believed I could take on Nascar in its entirety. I felt as far as the sport it needed to be looked at from a different view.”

Central Issue: Franchise System and Renewal Demands

The heart of the case involves the expiration of a 2016 deal where Nascar granted each team a “charter”. The concept is similar to other major leagues with independent franchises, such as the Charlotte Hornets or the NFL’s Panthers. This deal was due to end in 2024 when Nascar demanded charter membership renewals.

Jordan was on the witness stand for an hour and left the court to a media frenzy, with onlookers and reporters clamoring for a glimpse or a picture of the global icon.

Leading the Legal Charge

23XI Racing is leading the full-court press along with Front Row Motorsports for Nascar to change a business model Jordan contended is unlawful to maintain excessive control.

For Jordan and and a fellow team representative, who testified before Jordan, are events from last September. Gibbs described a hectic and tense six hours where the racing circuit told teams they had to sign a contract extension. The document spanned over a hundred pages outlining pay for chartered teams and a guaranteed spot in every race.

A Refusal to Sign

Jordan said that 23XI and Front Row Motorsports decided their sole viable path was to refuse a signature that 112-page package and take the issue to court. The other 13 organizations signed the agreement.

Jordan and co-owner Denny Hamlin reached out to Nascar about possible changes or extension options. Nascar wasn’t talking, according to his testimony.

The Bottom Line: Victory

But in the end, the pushback against what he saw as a unsustainable system was mostly about the familiar goal for Jordan: Winning.

“Hamlin persuaded me getting a third driver improved our chances to win,” he said, sharing that he bought a third charter late in 2024 for $28 million despite the uncertainty. “So I dove in.”

Gibbs described her request for permanent charters, submitted in a written letter to Nascar. She testified the timing of the contract signing demand was problematic.

According to her, Joe Gibbs first tried to call and talk Nascar out of demanding signatures, but Nascar’s leader declined the request.

“Don’t do this to us,” Gibbs recounted Joe Gibbs told Nascar’s leadership. She said France replied, “Whether I have 20 charters, that’s what I have. If I have 30, that’s the number.”
